Traffic Cameras a ‘Scam’ According to Ohio Judge

If you’ve ever questioned whether traffic cameras were legal you’re in honorable company. A judge in Hamilton County, Ohio recently struck down an ordinance allowing the town of Elmwood Place to use such cameras to catch speeders. Business owners had complained because the presence of cameras in their vicinity prompted many of the town’s 2,000 residents to avoid those areas and thus, the nearby businesses. But that wasn’t Judge Robert Ruehlman’s reason for ruling against the ordinance.  Infractions caught on camera result in a ticket being sent by mail. According to attorney Mike Allen who brought the challenge before Judge Ruehlman, the question is whether tickets delivered by mail violate a driver’s right to due process of law. In Judge Ruehlman’s opinion “Elmwood Place is engaged in nothing more than a high-tech game of Three-Card Monty. It is a scam the motorist cannot win.”
